General Terms and Conditions
For the BikeMates App and direct purchases
1. Scope and contracting parties
These General Terms and Conditions (hereinafter “GTC”) apply to the use of the BikeMates App as well as to all contracts for the purchase of products and services (e.g. GoldBiker memberships, physical items) concluded directly between you (hereinafter “user” or “buyer”) and us, the app operator:

Important note on third-party sales (marketplace): The BikeMates App contains an integrated shop through which independent third-party sellers (e.g. community operators) may also offer products. If you conclude a contract with such a third-party seller via the app, that contract is concluded exclusively between you and the respective third-party seller. The GTC of the respective third-party seller apply to these purchases; in this case the app operator does not become your contracting party.
2. Registration and paid services (GoldBiker)
Registration and the use of the basic functions of the app are free of charge for the user.
The user has the option of purchasing a paid extension of their membership (“GoldBiker status”) as a subscription or a one-off purchase in order to unlock additional premium functions. Billing and payment processing for in-app purchases of these services is carried out via the billing systems of the respective app store (Google Play Store or Apple App Store), subject to the terms of use applicable there. The provisions of the respective app store operator apply in addition to these in-app purchases.
In addition to being purchased for a fee, a membership (“GoldBiker” or “SilberBiker”) may also be granted free of charge – for example via the referral programme or by a community gifting it to a member from its BikePoints. Such a membership is always limited in time, does not give rise to any claim to continuation and is excluded from any refund. BikePoints are a platform-internal credit without monetary value; they can neither be paid out nor transferred nor exchanged for money.
Trophies awarded by a community to its members may grant access to individual products or provide a discount. The final price displayed in the shopping cart is decisive. If the trophy ceases to apply or its validity expires, the benefit linked to it also ceases to apply to future orders; orders already completed remain unaffected by this.
3. Conclusion of contract in the integrated shop
The presentation of the products in the integrated shop does not constitute a legally binding offer on our part, but a non-binding invitation to the user to submit a purchase offer.
By submitting an order via the “Order with obligation to pay” button, the user submits a binding purchase offer. After submitting the order, the buyer receives an automatic order confirmation by e-mail which documents receipt of the order but does not yet constitute acceptance of the offer.
A contract for products offered directly by the app operator is only concluded once we accept the buyer’s offer by way of a separate order acceptance by e-mail or dispatch the ordered goods to the buyer. We are entitled to reject offers within 5 working days.
The only language available for the conclusion of the contract is German. The text of the contract (order data and GTC) is stored by us after the conclusion of the contract and sent to the buyer by e-mail. In addition, the buyer can view their past orders in their user account (order history).
4. Prices, shipping costs and payment terms
The prices stated in the shop at the time of the order apply. All prices include statutory value added tax (where applicable) plus any shipping costs incurred. The specific shipping costs are clearly displayed to the buyer before the order is completed.
Payment for orders placed directly with the app operator is made via the payment service provider Stripe Inc. (e.g. by credit card, Google Pay, Apple Pay or Giropay). We reserve the right to exclude individual payment methods in individual cases.
5. Delivery and availability of goods
The ordered products are delivered to the delivery address specified by the buyer. Delivery times are stated with the respective products.
Should a product ordered by the buyer be permanently unavailable or out of stock, we reserve the right not to accept the offer or to withdraw from the contract. In this case we will inform the buyer without undue delay and refund any payments already made without undue delay.
6. Retention of title
The delivered goods remain the property of the app operator until all claims arising from the purchase contract have been paid in full.
7. Warranty
The statutory warranty rights (liability for defects) apply to all goods delivered directly by us. In the case of used goods, the warranty period may be governed differently, which will be pointed out separately in the product presentation.
8. Right of withdrawal
Consumers have a statutory right of withdrawal when concluding distance selling contracts. The details of the right of withdrawal for contracts with the app operator are set out in our separate withdrawal policy.
9. Limitation of liability and safety information
We are liable without limitation for damage resulting from injury to life, body or health based on a breach of duty by the app operator, as well as in cases of intent, gross negligence and fraudulent concealment. In the event of a slightly negligent breach of material contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.
Special safety information for motorcyclists: The BikeMates App (in particular ride recording, navigation, telemetry and lean angle measurement) may only be used in strict compliance with the applicable road traffic regulations (StVO). Operating the app while riding is prohibited. The app operator is not liable for accidents, damage to property or personal injury caused by distraction, improper mounting of the smartphone or of Bluetooth sensors (e.g. TPMS, PerformanceTracker) on the motorcycle, or by negligent riding behaviour on the part of the user in order to achieve certain statistics (e.g. lean angle leaderboards). Use is at the user’s own responsibility and own risk.
10. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In the case of consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.
If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Augsburg.
Information on online dispute resolution (ODR platform) and consumer arbitration: The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
